By the end of 2021, Kay was arrested for allegedly shooting and killing OY Wasca, a 24-year-old man whose real name is Oscar Hernandez in New York.

He and 7 others were indicted on the first-degree murder and racketeering charges in February 2023. Kay was supposed to face the death penalty but the US government decided to no longer seek for the penalty in July 2023.
